THE Court of Appeal has upheld a death sentence against four men, including a Police constable, convicted of armed robbery.

THE Court of Appeal has upheld a death sentence against four men, including a Police constable, convicted of armed robbery.

The men are Joseph Kaddu Mukasa, Hamuza Tuhamye, Edward Munana and Herbert Ahimbisibwe, the Police constable.

Ahimbisibwe was a bodyguard of the former deputy Chief Justice, Seth Manyindo, at the time the offence was committed.

Justices Steven George Engwau, Christine Kitumba and Constance Byamugisha unanimously ruled that the trial judge made no mistake in his judgment in 2004.

“The circumstances of this appeal are that there are no coexisting theories to destroy the inference of guilt.

So, the appeal by the appellants against the conviction and sentence of death must fail,” the court said in its judgment read by High Court registrar, Gladys Kisekka.

The court agreed with the Principal State Attorney, Caroline Nabaasa, that all the 23 prosecution witnesses gave consistent evidence during the trial.

The men stole over sh8m from the British American Tobacco shop in Fort Portal Municipality, Kabarole district on May 26, 2001.

Ahimbisibwa was issued with a pistol, an SMG gun and 30 rounds of ammunition, which were used in the robbery.

The court said Ahimbisibwe went into hiding after the robbery, because he knew he would be required to return the guns to the armoury.

He was arrested in 2002 when he reappeared.
