Defiler to serve 13 years in jail<br>Kampala<br>The Supreme Court confirmed a 13-year sentence imposed by the High Court against a man for defiling his wife’s 17-year-old niece. The convict, Isaac Turyatemba, of Mutundwe village in Lubaga Division, was to serve his sentence until 2013.

The Supreme Court confirmed a 13-year sentence imposed by the High Court against a man for defiling his wife’s 17-year-old niece. The convict, Isaac Turyatemba, of Mutundwe village in Lubaga Division, was to serve his sentence until 2013. After being convicted by Justice Julia Sebutinde in 2004, Turyatemba’s appeal was rejected by the Court of Appeal, so he appealed to the Supreme Court. Turyatemba pleaded that the sentence was harsh and excessive. He also complained that the Court of Appeal failed to subject all the evidence on record to fresh and exhaustive scrutiny and that the trial judge erred by convicting him without sufficient corroborative evidence.

The Court of Appeal last week rejected a plea of mental illness by Lieutenant Arthur Walubi. The court upheld the death sentence imposed on Walubi by the High Court for aggravated robbery. Three justices led by the Deputy Justice, Laetitia Mukasa Kikonyogo, unanimously ruled that the trial judge, the late Ignatius Mukanza, was justified to reject Walubi’s claim that he did not understand the charges against him due to mental illness. They agreed with the Principal State Attorney, Betty Khisa, that Walubi only pretended to be mentally ill when Mukanza tried to find out the legitimacy of a Police statement in which Walubi admitted having committed the offence, but which he had denied in court. Khisa alleged that Walubi, who was in charge of a roadblock at Kagezi village on Masaka-Kyotera road, robbed Vellasammy Sekarani of his vehicle and an unspecified amount of money on June 17, 1993 at gunpoint.
