Kyadondo East MP Sitenda Ssebalu has lost an election petition in which he sought a vote recount.
Ssebalu (right) was ordered to pay costs to FDC’s Sam Njuba.
Nakawa Court Chief Magistrate Deo Ninzeimana on Friday rejected Sitenda’s application, saying it did not have merit and that Sitenda had not shown good cause for a recount.
Ssebalu contested on the NRM ticket.
“The applicant (Sitenda) did not attach declaration forms to the case. The document he adduced in court is not signed by any EC official. The document is not for the court to rely on because anybody can compile such a tally sheet.
“I hereby dismiss the application with costs to be paid to Njuba,” Ninzeimana ordered.
Ssebalu’s lawyer Lawrence Tumwesigye said the tally forms presented by Njuba in support of his affidavit were not certified by the returning officer.
He said it was wrong for Njuba to allege that his client tampered with some ballot boxes that were found in a vehicle.
However, Njuba’s lawyer Yusufu Nsibambi, said Ssebalu sued a wrong party. He said it is the Electoral Commission that should be sued.
