THE Solicitor General (SG) has opposed the High Court ruling which rendered the Masaka Utoda-Put-Safe two-year contract to run the taxi park illegal.
Masaka High Court judge Kibuuka Musoke last Friday ordered Utoda-Put-Safe to vacate the park on grounds that the Municipality councillors did not have powers to award the tender.
However, the letter, addressed to the town clerk Masaka Municipal Council and dated August 31, signed by Joseph Matsiko, called for an appeal against the judgement.
The letter said the decision by councillors to extend the Utoda-Put-Safe contract to collect revenue from the taxi park was valid and lawful.
The letter said Katwe-Butego division, which sued Masaka Municipality for extending the contract, did not seek clearance from the office of the Attorney General.
The letter said the municipality had powers to extend the Utoda-Put-Safe contract without seeking clearance from the urban tender board under the circumstances.
It said Utoda-Put-Safe could not vacate the park as ruled by the High Court because they are not party to the case.
The letter warned that Masaka Municipal Council would incur heavy costs to compensate Utoda-Put-Safe if the High Court order to evict them was effected.
Deputy town clerk Gwava Kiwanuka had advised against opposing the High Court ruling.
