GOLF Course Holdings (GCH), owners of the Garden City, have sued Jubilee Insurance for sh562m.
GCH’s chief Mannu Chotai told court the claim was an insurance cover for the delays in completion of the complex. Chotai said Jubilee undertook to compensate GCH, in case Malva Construction failed to complete the work.
, but breached the undertaking.
Malva won the tender to construct the garden city complex in 2000 and abandoned it in 2002.
Saying Malva suddenly abandoned the work, Chotai added, “ we informed Jubilee Insurance accordingly. They wrote (Jubilee) back, recommending that the matter be put to arbitration.”
Saying the arbitrator found in GCH’s favour and court sanctioned the arbitrator’s verdict, Chotai added Jubilee still refused to pay them.
“ We complained to the Uganda Insurance Commission, which wrote back, saying Jubilee had contested liability,” said Chotai, who was being guided by his lawyer, Allan Shonubi.
Chotai said GCH incurred $1m losses in rent and further payments to complete the Garden city complex. He asked court to have Jubilee Insurance foot the said expenditure, besides paying the sh562m.
