Tunisians Apply For Resumption Of NHI Case

TAHAR Fourati Hotels International Limited, a Tunisian company of hoteliers, is back in the Commercial Court trying to have its $1m (over sh2b) case re-instated against the State.

TAHAR Fourati Hotels International Limited, a Tunisian company of hoteliers, is back in the Commercial Court trying to have its $1m (over sh2b) case re-instated against the State.
In their application, Fourati say they are ready to deposit in court sh25m as security for costs so that the case is heard.
The Commercial Court, on January 14 this year, dismissed Fourati’s case for failure to deposit in court sh25m within 15 days, as security for costs, before it could appeal against a judgment in which it lost to the Government.
Fourati Hotels had sued the Government and the then Nile Hotel International Limited (NHI) for breach of contract, in a bid to recover $1,070,176 as damages for alleged wrongful termination of its management contract of the hotel.
In its notice of motion for the reinstatement, Fourati Hotels, said the case involves a lot of money and court was mistaken that the time within which to furnish security for costs had not run out.
