CAO sues over censure

INTERDICTED Tororo chief administrative officer (CAO) has petitioned the Constitutional Court to nullify the appointment of an acting CAO, saying he still holds office.

Silver Oboth, who was stripped of his powers as the district accounting officer last July, wants the court to declare the move unconstitutional.

In a May 31 petition filed in the Court of Appeal, Oboth is challenging the powers of the Secretary to the Treasury in appointing Julius Ogema as acting CAO.

Oboth said the Public Finance and Accountability Act, under which the Secretary acted over Oboth’s alleged lack of accountability was unconstitutional.

Oboth denied the allegation, saying the problem existed before he became CAO.
Oboth further contends that as long as he had not been sacked as CAO, he should be the accounting officer of the district as per Article 188(2) of the Constitution.

The wrangle threatened to split the district last year when the district council threatened to censure the LC5 chairperson, Nuwa Owora, for allegedly revoking Oboth’s powers.
Owora said the Secretary to the Treasury threatened to withhold funds to the district last August if Oboth remained in office.

The Attorney General has not yet responded.
