THE Crested Crane Hotel and Tourism Training School in Jinja risks eviction after their landlords ran to court seeking eviction orders and recovery of over sh227m in rent.
The trustees of the Uganda Young Men’s Christian Association (UYMCA), through their attorneys Lukwago, Alaka and Company Advocates, have filed the suit in the High Court, praying for eviction orders and payment of the outstanding rent.
They contend that by a tenancy agreement dated April 7, 1999 thier clients let out their premises at plot 16/24 Nalufenya, Jinja municipality, to the hotel and tourism school, to rent it for a period of five years.
“The defendants took immediate possession of the premises but failed to pay the reserved rent as agreed in the payment schedule with the result that by the time the tenancy period expired on July 31, 2004, they had only paid sh216,043,135, leaving a balance of sh203,040,641, which is still outstanding,” Lukwago said.
He said despite the expiry of the tenancy agreement on July 31, 2004, the defendant has refused to vacate the premises.
UYMCA further claim sh21,396,208, as profits for August and September 2004.
In an affidavit sworn by Robert Jumba on behalf of the trustees, he said through their agents, they had refused to accept the proposal to rent to them their premises but at the request of the defendant, they allowed the defendant to pay for it as they sort out their problems.
“We demanded for the full amount stipulated in the tenancy agreement, but the defendant has refused to pay.”
The hotel was supposed to pay sh5,010,300 per month in 1999, sh7,348,440 per month in 2000, sh8,818,128, sh10,581,754 and sh12,698,104 in 2001, 2002 and 2003 per month respectively.Ends
