THE Court of Appeal ruled on Wednesday that lawyers representing James Garuga Musinguzi are justified to submit reports on election violence by security organs in Kinkizi West Constituency.
The lawyers representing defence minister Amama Mbabazi and the Electoral Commission (EC) in an appeal against the High Court decision to nullify Mbabazi’s election, had raised the objection.
They said Musinguzi’s lawyers should not submit on the reports, because the trial judge had not considered them.
In a ruling read by Deputy Chief Justice Laetitia Kikonyogo the justices said, “We find no merit in the objections by the appellants’ lawyers and they are overruled.”
Mbabazi and the EC had appealed against the High Court judgement, saying the judge was biased and did not consider their affidavits. b>Ends
