By Hillary Nsambu THE last appeal by Kampala Indian business brothers, Kooky Sharma and Davindar Kumar, sentenced to death for killing Kooky’s wife, is set for today and tomorrow. A coram of five judges, including Chief Justice Benjamin Odoki (chairman), will hear the appeal. The other justices on the panel are John Tsekooko, Alfred Karokora, Joseph Mulenga and George William Kanyeihamba. Kooky hired Kampala senior criminal lawyer, Porotazio Ayigihugu, who will team up with another senior lawyer, Ezekiel Nsubuga Mubiru and Michael Akampurira for the last battle. Senior Principal State Attorney Simon Byabakama Mugenyi, who appeared for the state from the trial court through the first appellate court, is expected to complete the case at the Supreme Court. The High Court trial judge, Moses Mukiibi, on January 17, 2000 convicted and sentenced to death Sharma Kooky and Davinder Kumar. The two men were found guilty of killing Kooky’s wife Renu Joshi by electric burns on the Christmas eve of 1997 at Plot 43 Martin Road, Old Kampala. At their first appeal, Justices Seth T. Manyindo (retired), Alice Mpagi Bahigeine and Joseph Patrick Berko unanimously dismissed all the 11 grounds of appeal by the brothers, saying they were properly convicted. Kooky and Kumar, however, insist they did not kill Joshi as there had been no electricity in the area for two days. Kumar also said he was not in Kooky’s house that night. Ends
