Katongole’s lawyer grills Kasibante

FORMER candidate in the Rubaga North parliamentary election Moses Kasibante yesterday told court that he is convinced he won the poll.

Kasibante was under cross-examination by Simon Tendo Kabenge, one of the lawyers of MP Singh Katongole, over allegations that the recounting of the votes robbed him of the victory.

Other lawyers for Katongole were Dr. James Akampumuza and Fox Odoi.

In the petition, which was filed in March, Kasibante alleges that the Electoral Commission (EC), and Katongole connived to rob him of his victory through an illegal vote recount exercise.

Kasibante, who underwent intense cross-examination the whole day, on many occasions asked the court to protect him from some questions, which he said were on points of law which he was not conversant with.

Akampumuza, who cross-examined Kasibante for the entire afternoon, had to apologise to court when trial judge, Vincent Musoke-Kibuuka, intervened and asked Kasibante not to answer a question that concerned law which he was not conversant with.

Akampumuza had insinuated that Kasibante had had the best protection ever.

Kasibante told court that initially, on February 20 the EC declared him the winner with 24,054, against Katongole’s 18,595 votes.

Seven other candidates took part in the race.

However, Kasibante claims that when the then Mengo Chief Magistrate, Phillip Odochi, ordered for a recount of the votes, Katongole was declared winner with 24,802 votes. In that recount, Kasibante came second with 22,850 votes.

Kabenge wondered why Kasibante petitioned court, yet he was pronounced winner after 134 polling stations were declared out of a total of 141 polling stations.

“I put it to you that from the annexture A of your affidavit, you were declared winner from 134 polling stations, out of the 141 polling stations,” Kabenge said.

Kasibante, however, conceded that he was declared winner before all results from 141 polling stations had been tallied.

Kasibante was represented by Medard Lubega Seggona, and Abdullah Kiwanuka.

Akampumuza continues today with his cross-examination before EC lawyer cross-examines him.
