Nabwiso wins election petition against NRM’s Nkayi

THE former MP of Kagoma county in Jinja district, Dr. Frank Nabwiso, yesterday shed tears of joy after winning an election petition against the incumbent, Frederrick Mbagadhi Nkayi.

THE former MP of Kagoma county in Jinja district, Dr. Frank Nabwiso, yesterday shed tears of joy after winning an election petition against the incumbent, Frederrick Mbagadhi Nkayi.

Nabwiso, who was among the vocal opposition legislators in the seventh Parliament, had filed a petition against Nkayi’s victory in the February polls. The Electoral Commission (EC) announced Nkayi as the winner of the eleven-man race, beating Nabwiso, who was his closest rival, with a difference of about 700 votes.

In his judgment, Jinja High Court judge, Justice Lameka Mukasa, said the EC had failed to conduct the polls in accordance with the electoral and parliamentary laws.

In the ruling that was delivered by Justice Eldad Mwangushya, Mukasa also upheld Nabwiso’s submission that the EC miscomputed results from at least 15 polling stations to favour of Nkayi.

During the hearing, court conducted a recount of votes from Mutai II polling station. It was found that Nkayi’s votes had been increased by three from 94 votes to 97.

Based on this finding, court accused the EC of failing to exercise the principles of transparency in the entire exercise.

“Court finds it that the second respondent was not validly elected and it is also unable to find that the petitioner won and cannot declare him winner and, therefore, fresh elections be conducted,” Mukasa said.

He also ordered that the EC takes full responsibility and pay costs incurred by the petitioner, Nabwiso, and Nkayi.

Nabwiso last evening vowed to petition the EC to ensure that the Jinja district returning officer, Flavia Mujulizi is withdrawn and got rid from the area because court has exposed her weaknesses.

He also advised Mujulizi to resign because court exposed her weakness that she is incompetent.

Nkayi, declined to talk to the press saying; “I am going to organize myself,” he said.

Nabwiso was accompanied by former candidates who included Moses Batwala, Alex Kintu, and Moses Walyomu. He was also flanked by party diehards who included Maureen Kyalya, Paul Mwiru and Abed Mudiobole.
