CITY tycoon Godfrey Kato Kajubi has lost an appeal in the Supreme Court where he had sought orders stopping his retrial for murder.

CITY tycoon Godfrey Kato Kajubi has lost an appeal in the Supreme Court where he had sought orders stopping his retrial for murder.

This means that the security is at liberty to re-arrest Kajubi and arraign him in the High Court for retrial before another judge for the murder of a-12-year-old boy, Joseph Kasirye.

The Supreme Court on Monday threw out Kajubi’s notice of appeal saying that he had failed to file a memorandum of appeal within the prescribed period of 14 days since he lodged the notice of appeal in November 2010.

The Chief Justice, Benjamin Odoki led the coram. Other members were Justices John Wilson Tsekooko, Bart Katureebe, Christine Kitumba and Jotham Tumwesigye.

Earlier, Kajubi’s lawyers that had been provided by the state, Abbas Bukenya, who was holding brief for Musa Kabega, told the court that they were unable to proceed with the appeal because they had failed to find Kajubi and; therefore, they were unable to prepare a memorandum of appeal.

The lawyers had sought permission for more time to enable them trace Kajubi in order to file the memorandum of appeal.

However, the Principal State Attorney Alice Komuhanga Khaukha, objected to the application saying that Kajubi had lost interest in his appeal and it should be dismissed.
