Former DP president Ssebaana sued over land deal

Ssebaana’s interest in the land was extinguished when the High Court annulled his interest therein

Former Democratic Party President (DP) John Ssebaana Kizito has been dragged to the civil division of the High Court for failure to hand over a piece of land that he sold to a one Anthony Kavule.

Kavule alleges that he entered into an agreement with Ssebaana for the purchase of two acres of land at Kyadondo Block 169 Plot 230 at Kabubbu at a consideration of sh51m.

Through KMT Advocates, Kavule states that the said consideration was paid to Ssebaana and duly acknowledged it.

He states that there were court proceedings over the suit land contesting Ssebaana's proprietorship and the same went on for a long time.

The court documents indicate that Ssebaana's interest in the land was extinguished when the High Court annulled his interest therein thus frustrating the transfer and enjoyment of the land by Kavule  which has in turn caused him financial loss and emotional distress.

Kavule contends that he has relentlessly demanded a refund of the consideration to no avail.

He further avers that as a result of Ssebaana's conduct, he has suffered loss and damage for being denied use and enjoyment of the suit land after his funds were received by Ssebaana.

According to the plaint, Ssebaana has defence to the suit and notice of intention to sue was duly communicated to him but he adamantly ignored the same.

Kavule wants court to order Ssebaana to pay him sh51m being payment of the consideration paid to him and costs of the suit.
