Court rejects transfer of Besigye's case to Luzira court

Chief Magistrate James Ereemye Mawanda on Wednesday rejected an application by the State to refer the case to Luzira court.

Nakawa Chief Magistrate's court has declined to refer a case in which opposition leader Dr. Kizza Besigye is charged with treason to Luzira court.

Chief Magistrate James Ereemye Mawanda on Wednesday rejected an application by the State to refer the case to Luzira court on grounds that the submissions were not supported by any evidence that court would premise on to move the mentioning of the case to another place.

In regard to security threats, the presiding magistrate said if security was a concern no guarantees were told court by prosecution intended to avert the treats feared if any when the case is moved to Luzira court or any other place.

"All prosecution allegations were hearsay and prosecution should have known that for such an application to be allowed, there should have been furnished to this court evidence of such threats by way of affidavit or otherwise in open court or in camera depending on the nature of such evidence," the chief magistrate advised.
