Justice Kavuma gives Lukwago a green light

Justice Kavuma advised Lukwago to file an application inviting court to expedite the application for a stay and a panel of three judges will be allocated to handle the case if he wants to access his office for the old term.

The Deputy Chief Justice, Steven Kavuma, has allowed Kampala Lord Mayor, Erias Lukwago, to file a formal application requesting court to fix and hear the application for stay of execution of Justice Lydia Mugambe's ruling implementation by the Attorney general (AG) and Kampala Capital City Authority (KCCA) legal teams.

This was during an interaction with the legal teams of the three parties on Friday at his chambers in Kampala.

Justice Kavuma advised Lukwago to file an application inviting court to expedite the application for a stay and a panel of three judges will be allocated to handle the case if he wants to access his office for the old term.

This means that Lukwago also the Lord Mayor -elect cannot access his office before the final determination of the stay application for this term which expires in mid-May this year.

 

After the about one hour closed interaction between the parties, Lukwago's lawyer Peter Walubiri said that they decided to meet Justice Kavuma since he issued the order barring Lukwago to access his office after justice Mugambe had ordered his return.

"I am glad that the court has allowed us to apply to court requesting it to cause list the case for hearing very soon." Walubiri said.

Lukwago who was part of the meeting said that he respects the courts and ready to abide with its lawful orders.

"We have to complete all issues concerning my current term because I was a duly elected lord mayor of Kampala. I respect those who say that I should wait for May swearing but I am sorry, I cannot allow illegality" Lukwago said.

He also noted that he has no matter pending in the Court of Appeal or in the Supreme Court and he is a successful litigant and all that is left is for him is to enjoy the fruits of  the successful litigation.

Justice Mugambe in 2014 ordered Lukwago to return to his office. she stated that the injunctive orders against the EC not to organize by-elections will be in place until Lukwago's main application, in which he is challenging the KCCA tribunal report that led to his controversial impeachment on November 25 last year, is disposed of.

 Immediately, Justice Kavuma issued an order for Lukwago not to perform any functions of the Lord Mayor until the AG's appeal is heard and determined.

However, the Supreme Court Justices, led by former Chief Justice Benjamin Odoki, referred Lukwago back to a three-man panel of Court of Appeal Justices.

Lukwago was represented by three lawyers led by Walubiri, Medard Sseggona and Abdu Katuntu while the AG and KCCA were represented by Lawyers Martin Mwangusya, Gerald Batanda, Charles Ouma and Dickens Akena. End
