Judge to sum up in July 11 terror trial

During the last court session of April 5, the judge deferred the summing up to April 11.

KAMPALA - Justice Alfonso Owiny-Dollo, who is hearing the trial of 13 men accused of masterminding the July 11, 2010 Kampala bombings, is expected to sum up the lengthy trial to the assessors today.

The assessors include Juliet Kasendwa and David Lubega.           

When summing up the evidence, the judge normally states the issues and what the assessors are required to find. He/she also states the substance of the prosecution's evidence and the defence.                 

During the last court session of April 5, the judge deferred the summing up to April 11, saying he had inevitable issues unrelated to the case.           

With the exception of Muzafar Luyima and Muslim cleric Dr. Ismael Kalule, the others are accused of terrorism.         

They Include: Hussein Hassan Agad, Idris Magondu, Isa Ahamed Luyima, Hassan Haruna Luyima, Abubakari Batematyo, Yahya Suleiman Mbuthia, Habib Suleiman Njoroge, Omar Awadh, Mohammad Hamid Sulaiman, Seleman Hijar Nyamandondo, and Mohammad Ali.             

They are also facing charges of murder, with each charged with 76 counts for murder.           

The suspects are also accused of attempted murder, with each facing 10 counts. They are also charged with "belonging to a terror organization", contrary to Section 11 of the Anti-Terrorism Act (ATA).           

Kalule is separately charged with aiding and abetting terrorism, contrary to Section 8 of the Anti-Terrorism Act.           

Luyima is separately charged with "being an accessory after the fact" contrary to Section 29 of the ATA.           

A total of 76 people perished in the two bombings that occurred at Kyadondo Rugby Club and the Ethiopian Village Restaurant in Kabalagala six years ago.

Many others were injured.

At the time, revelers were watching the World Cup final between Spain and Holland, which was being played in South Africa.           

A third bomb, planted at Makindye House in the city suburbs of Makindye, failed to go off and was recovered the following day.
