No vote recount for Butambala Woman MP Seat - Court rules

Mar 29, 2016

Lwanga refused to grant the recount on grounds that it was overtaken by events since Mirembe's name was already put in the gazette by Electoral commission (EC).

Nakawa High Court judge has declined to grant orders for a vote recount for Butambala woman MP as sought by former Kampala Resident City Commissioner (RCC), Aisha Kabanda.

In her ruling Tuesday, Justice Damalie Lwanga refused to grant the recount on grounds that it was overtaken by events since Mirembe's name was already put in the gazette by Electoral commission (EC).

"It is no longer relevant to have are count, the applicant (Kabanda) is hereby advised to petition the high court if need be to challenge the whole process regarding the Butambala woman MP election." Lwanga ruled.

Kabanda lost the Butambala woman MP election to independent candidate Daphine Lydia Mirembe who got 14,760 votes while Kabanda (NRM) achieved 14,693 votes.

However, Kabanda refused to concede the defeat and sought a court order for a vote recount at Mpigi Chief Magistrate Court.

Mpigi Chief Magistrate Jolly Nkore permitted it but refused to conduct exercise after was served with an appeal for stay by Mirembe.

This prompted Kabanda through her lawyer Cecilia Nagawa to petition the high court seeking for a review of proceedings at Mpigi court.
