A 26 year old man living with HIV has been remanded to Gulu main prison for raping his late brother's wife and infecting her with a different strain of HIV.

Court presided over by Lady Justice Margaret Mutonyi  at the Gulu High Court, heard that Sunday Tabo Denis Ogenrwot, a resident of Akwir village, Pawel parish in Patiko Sub County committed the offence on 20th November 2014

Prosecution led by Patrick Omiya heard that Ogenrwot sneaked into the house of his late brother at around 9pm on the fateful night.

He hid inside the house and waited for her to return before grabbing and raping her.

Ogenrwot who pleaded guilty to the charge, told court that he did it to avenge his brother's death, which he says was caused by the rape victim. He blamed her for infected his brother with HIV.

Court however heard that Ogenrwot's act left the victim, who is also HIV positive and on ARV treatment, in a coma. She only regained consciousness at Ajulu Health Centre II where she was rushed after the incident.

Justice Mutonyi observed that Ogenrwot's act was malicious, as it was intended to re-infect his late brother's wife with a different strain of the HIV virus.

Ogenrwot will reappear in court on 21st March, for further hearing.
