The High Court has dismissed a case in which a businessman, Ismail Mpanga, was seeking court order to compel city socialite Shanita Namuyimbwa popularly known as Bad Black to pay sh105m debt.

The High Court has dismissed a case in which a businessman, Ismail Mpanga, was seeking court order to compel city socialite Shanita Namuyimbwa popularly known as Bad Black to pay sh105m debt.
In his ruling, Justice David Wangutusi ordered that Bad Black be paid all costs incurred in the case since she was wrongly accused.
Bad Black’s lawyer, Abel Kahara will prepare the costs spent.
The judge dismissed the application based on the evidence adduced before court.

Justice Wangutusi said it was wrong for the businessman to sue her, saying that evidence clearly showed that Bad black had given Mpanga her car (mercedz benz) worth sh150m and all its documents.
“The fact that Uganda Revenue Authority (URA) did not transfer the alleged car in the names of Mpanga does not mean that Bad Black had changed position after handing over car documents to him,” Wangutusi stated.
He said Mpanga ought to have found out how to transfer the said car since it was in his possession and valued worth sh150m.
Clad in a pink blouse and a black spotted legging, Black looked composed as the judge gave his verdict in an open court.
Mpanga had filed the suit against Bad Black on November 28, 2011 claiming she had borrowed from him sh105m and promised to pay within a month in which she defaulted.
Bad Black in turn deposited her original copy of the log book for Range Rover registration number UAP 838L in lieu of the BMW as security.

Mpanga had earlier contended that Black gave him additional security for the loan in form of a post-dated cheque number 800038 to be cashed at Standard Chartered Bank.
Mpanga was to draw sh80m from her account in the event that she failed to pay the loan as agreed.
“The aforesaid cheque was banked on November 9, 2011 and I was informed by the bank that her account had been closed so the cheque couldn’t be honoured,” Mpanga said.
Bad Black is currently in Luzira prison serving a four-year jail sentence.
