Daveshan Development (U) Limited, a company owned by a British national, David Greenhalgh, the former boyfriend of Shanita Namuyimbwa, best known as Bad Black, has dragged the Attorney General and the Commissioner General of Prisons to court seeking orders returning Meddie Ssentongo to prison.

The applicant, Daveshan Development alleges that, Ssentongo, who was convicted and sentenced with Bad Black of embezzlement, was released from Luzira before he completed his 18-moths-jail-term.

Meddie Ssentongo is allegedly another Bad Black’s Ugandan boyfriend with whom she was tried, convicted and sentenced to 18 months imprisonment, while Namuyimbwa was ordered by the Anti-Corruption Court, sitting at Kololo in Kampala, to serve a-4-year term in Luzira prison for embezzling sh11b belonging to Daveshan Development (U) Litd.

According to the application filed in the High Court by Fitz Patrick Furah & Company Advocates, the applicant wants the respondents to arrest Ssentongo and produce him in court so that he could be returned to Luzira to complete his sentence.

The application that was filed in court on November 27, 2013 also seeks an order requiring the respondents to clarify why Ssentongo left prison before he could complete his sentence. I was said that  Ssentongo was supposed to leave the prison next April.   

“The premature release of Meddie Ssentongo from Luzira prison is unlawful and had no legal basis. It smirks of malafides on the part of the Attorney General and the Luzira Prison authority. It is also an abuse of the law and court process as a whole,” according to an affidavit by Moses Wacha in support of the application by Daveshan Development.

However, when asked, Dr Johnson Byabashaija,the Commissioner General of Prisons, told The New Vision on phone yesterday while it is true Meddie Ssentongo was imprisoned for 18 months by the Anti-Corruption Court in July 2012, he was given a remission of his term, which he was entitled to, because he was found to be well behaved.
