FUFA 'not bothered' by court injunction

FUFA will carry on their work normally despite an injunction by the Constitutional Court against the Attorney General, the Ministry of Education and Sports, National Council of Sports and any other government organ, their agents or servants restraining them from recognizing FUFA Limited as the recognized national association.

Addressing a press conference at FUFA house yesterday FUFA lawyer Alex Luganda said the FUFA Super League and the FUFA assembly due at Njeru tomorrow will go on as scheduled.

Luganda said the written communication to which FUFA was equally copied, directed to the Ministry of Education and Sports, authored by Muwema and Mugerwa and Co advocates on behalf of USLL alleges certain information which is false and wrong both in law and fact.

“I want to clarify and set the record straight to the public and the media that the court order that was issued was issued in the case of Uganda Super League Limited versus the Attorney General and FUFA the association and its legal arm FUFA Ltd were not part and parcel of that case and the orders that were issued by the honorable court were directed at the AG, the MOES and other government agencies,” Luganda said

“We have had an opportunity of looking at the court order and nowhere in that order does court declare FUFA illegal or as being an illegal entity and there is nowhere in that court order does it stop FUFA from carrying out its activities” Luganda stated.

About the FUFA Super League he said that is run by an independent entity which is constituted by clubs playing in the super league through their company FUFA Super League Ltd and that there is no order stopping their activities.

“In respect to the activities of the federation; the general assembly and the elections were planned and conducted within the association constitution of FUFA ,so they will go ahead as planned and there is no court order stopping them and nobody can lawfully stop the elections and the FUFA assembly,”

He said anybody who does so will be interfering with lawful activities, and dared anyone to try as they would be the ones be in contempt and breach of the law.

But on Wednesday USLL lawyer Fred Muwema said that:  “From the time the order was issued we don’t have in place a FUFA Ltd or FUFA does not exist and that means that any activities conducted by FUFA like the Super league have been stayed. It also means activities by this illegal organization in form of elections have been stopped; Why? Because the existence of FUFA is dependent on recognition and endorsement from government that why when FIFA is allowing affiliation of a national association it gets certification from government,” Muwema said. 

If anyone disobeys the court order it will lead to catastrophic consquences by arrest or imprisonment.

Luganda also gave further clalification on the FUFA Limited saying it is only a legal arm of the federation which when it was created did not replace FUFA the Association.

FUFA Vice President-Techinical Mujib Kasule also dismissed the 'threats' of the injuction saying the Uganda Super League were not genuine people.

"You cannot say that the injunction stops everything about FUFA but not the Cranes. So who is in charge of the team?" Kasule wondered

We have not broken any law by registering a legal arm of FUFA and no body will bring you a law that we have broken. There is no article in the NCS act that stops any association registering as a company and if it's there let them show it to us. Laws are being formulated as we speak and its is a process by the NCS, ministry and the task force, so FUFA cannot break the laws in the process of their formulation, these people are just haunting us," Mujib stated.
