Court stops Basajja fraud trial

The Constitutional Court has stopped the trial of local entrepreneur Hassan Basajjabalaba and his brother, Muzamiru Basajjabalaba, over a sh145b fraud case.

The Constitutional Court has stopped the trial of local entrepreneur Hassan Basajjabalaba and his brother, Muzamiru Basajjabalaba, over a sh145b fraud case.

The trial was scheduled for Thursday at the Anti- Corruption Court before Justice Catherine Bamugemereire.

However, the Constitution Court late on Wednesday ruled that the trial be halted until a petition filed by the two suspects is disposed of.

The Constitution Court was presided over by a Coram of three justices – Steven Kavuma, Remmy Kasule and Augustine Nshimye.

The court also issued an injunction prohibiting the Attorney General from using any other process so as to initiate and prosecute the Basajjabalaba brothers for any charges in connection with the compensation of the Haba Group Ltd.

The judges at the constitutional court also ordered that the Basajjabalabas’ passports be given to the Registrar of the Constitutional Court and that the suspects are free to access their passports whenever they require them.

Among others, the two brothers are alleged to have conspired to prevent the execution of tax in respect of taxes amounting to sh20b, arising from a compensation award by the Government to Haba Group Uganda Ltd.
