Prof Ndiege loses case against Kyambogo

KAMPALA - Kyambogo University vice-chancellor Prof. Isaiah Ndiege, on Monday lost a case against the institution. The High Court in Kampala ruled that, his petition protesting that his purported dismissal, was premature.

In the ruling, Justice Benjamin Kabiito noted that the university’s council has never reached a decision to dismiss Ndiege, but merely recommended his removal from office.

The judge advised the parties to wait for the outcome of the university’s internal disciplinary mechanisms.

“Parties should submit to the internal disciplinary mechanisms of the university council with a view of exhausting and resolving the matter, failure of which they can return to court,” stated the judge, in the presence of Ndiege, who was ordered to pay costs to the university.

On the same day, court announced the expiry of the order issued on November 26, which required Ndiege to stay away from the university premises, pending the outcome of the main case.

The case arose on November 6 when Ndiege filed an application for judicial review against the university, contending that his dismissal was baseless since a probe report into mismanagement of the institution cleared him.

Judicial review is conducted by the High Court to scrutinise proceedings plus decisions taken by subordinate courts, inferior tribunals and Government bodies.

The Kenyan national was appointed on December 4, 2008. He maintains that his appointment was to curb rampant corruption, and incompetence among administrators at the institution.
