Sacked Kyambogo University vice chancellor Prof. Isaiah Omolo Ndiege has petitioned the High Court to quash the decision of the university council to relieve him from duty, claiming his dismissal was malicious.

Sacked Kyambogo University vice chancellor Prof. Isaiah Omolo Ndiege has petitioned the High Court to quash the decision of the university council to relieve him from duty, claiming his dismissal was malicious.

Ndiege was sacked by the university council in public interest during a meeting on October 31 at Hotel Africana in Kampala.

In his application for judicial review filed on Tuesday through Akile, Olok and Company Advocates, Ndiege contends that his dismissal was baseless since a probe report into mismanagement at the institution, cleared him.

Judicial review is conducted by the High Court in relation to proceedings plus decisions taken by subordinate courts and inferior tribunals or bodies.

In an affidavit sworn in support of the application, Ndiege claims the university council chairperson Prof. John Yakobo Okedi, harbours a grudge against him over the purported sale of the university land.

"In bad taste, the  chairperson university council  Prof. John Yakobo Okedi, had personal issues with the applicant(Ndiege), as he had issued through his lawyers notice of intention to sue over a story published in the media arising from alleged sale of university land,"  Ndiege states.

Additionally, he contends that council was composed of complainants, who subsequently acted as judges, and sacked him without a fresh hearing. Ndiege states that his human rights were breached, and that he got to know his dismissal through media reports.

The Kenyan national, who was appointed on December 4, 2008, asserts that his appointment was in reaction to rampant corruption, and incompetence among administrators at the institution.

 He asserts that as part of his mandate, he implemented his policy on zero tolerance to corruption by closing the channels through which resources were squandered.

The case file has been allocated to Justice Benjamin Kabiito. A hearing date is yet to be fixed
