THE opposition FDC party vice-president, Salaamu Musumba, has lost a petition she filed challenging the election of Stephen Mubiru (NRM) as Kamuli district chairman in 2007.

THE opposition FDC party vice-president, Salaamu Musumba, has lost a petition she filed challenging the election of Stephen Mubiru (NRM) as Kamuli district chairman in 2007.

In the petition, Musumba cited malpractices in the byelection and asked the High Court in Jinja to declare Mubiru’s election null and void.

The judgment was delivered by the assistant registrar of Jinja High Court, Muse Musimbi, on behalf of Justice Vincent Zehurikize Tiwanye.

Reading the judgment, Musimbi said the petitioner sought court to address several issues in the byelection that included failure by the Electoral Commission to conduct comprehensive civic education during campaigns and free and fair elections.

“The petitioner had to prove to court that these irregularities happened and, therefore, influenced the final results,” Musimbi said.
He said the petitioner failed to prove her case to the satisfaction of court and the remedies sought could not be addressed.

“The case is hereby dismissed with costs and these will be borne by the petitioner,” he said.

The Kamuli byelections followed the cancellation of the 2006 election of Ahmed Kawugu Kawooya after court found that he did not have the required academic qualifications.

Musumba expressed dissatisfaction with the ruling, saying the people of Kamuli have been denied justice.

“We are neither surprised nor shocked. We are just laughing it off,” Musumba said.

On her next move, Musumba said she will first consult her lawyer Wandera Ogalo.
