IGG loses case against Gasasira

The IGG has lost an appeal in which he had asked court not to implement its decision against attaching properties of Nestor Machumbi Gasasira, the health ministry principal accountant.

The IGG has lost an appeal in which he had asked court not to implement its decision against attaching properties of Nestor Machumbi Gasasira, the health ministry principal accountant.

The High Court had earlier dismissed an application in which the IGG wanted Gasasira’s property attached and have him dismissed from public service for allegedly amassing wealth that is not commensurate to his earnings.

Following the dismissal, the IGG appealed to the same court, asking it to stay its decision until their intended appeal against the decision in the Court of Appeal is heard.

But when the IGG failed to show up to defend the application on Tuesday, High Court judge Yorokamu Bamwine dismissed it.

“The application to stay execution of the decree in civil appeal number 62 of 2009 is hereby dismissed. The applicant (IGG) shall pay costs of this application to the respondent (Gasasira),” Bamwine said.

This implies that the IGG can not have Gasasira terminated from public service or have his property attached.

The IGG had accused Gasasira of not declaring his wealth and failing to explain its source. Gasasira, however, challenged the move by the IGG, saying he worked for 31 years to acquire the wealth he jointly owned by his wife, who also works as an accountant.

In his earlier ruling, Bamwine said the IGG had not offered Gasasira an opportunity to defend himself.
