Busoga royal backs anti-Kyabazinga petition

THE Isabalangira of Busoga (chief prince), David Kawunhe Wakhooli, has backed a petition seeking to nullify the election of Edward Wambuzi Zibondo as the new Kyabazinga.

THE Isabalangira of Busoga (chief prince), David Kawunhe Wakhooli, has backed a petition seeking to nullify the election of Edward Wambuzi Zibondo as the new Kyabazinga.

Wakhooli, who is also the acting Kyabazinga, announced this in a letter of July 20 to the registrar of the Constitutional Court.

“This is to inform you that after a thorough review of the Busoga culture, I am satisfied that the above petition raises correct issues for constitutional interpretation and agree with the position of the petitioners. I no longer oppose the petition and I request you to inform their lordships of this position, Wakhooli said.

Wambuzi is the son and heir of the late Henry Wako Mulooki, former Kyabazinga, who died on September 1, 2008. The withdrawal of Wakhooli left Wilson Muweereza, the embattled Katuukiro (prime minister) and the Attorney General as the only respondents, who, though represented in court, did not have a chance to respond to the petition because they had earlier lost their chance to do so.

John Matovu of Matovu and Matovu Advocates and the Principal State Attorney, Henry Oluka, who represented Muweereza and the Attorney General respectively simply looked on as the petitioners presented their case to court.

The court, headed by the acting deputy Chief Justice, Alice Mpagi-Bahigeine, said it would give its judgment on a later date Cranmer Sajjabbi Imaka and Abubakari Kakaire in October 2008 petitioned the Constitutional Court challenging the 2000 constitution of the Busoga kingdom under which the present Kyabazinga, Wambuzi, was elected.

They are also seeking a permanent injunction stopping the respondents from conducting any other elections of the Kyabazinga under the constitution, arguing that it was made without the consent of the lukiiko (parliament).
