Dad jailed for life for defiling his baby

THE Supreme Court has confirmed a sentence of life imprisonment against a man from Kamuli District who defiled his one-year-old-daughter.

THE Supreme Court has confirmed a sentence of life imprisonment against a man from Kamuli District who defiled his one-year-old-daughter.

Swaibu Kikonyogo of Bukose village, Namamba sub-county in Busoga had appealed to the highest court of the land, arguing that the sentence was excessive.

He had complained that the Court of Appeal had failed to properly re-evaluate the evidence of the blood stains found on his trousers upon his arrest.

The prosecution had told the court that on March 23, 2000 the mother of the victim left the sleeping baby in the care of her father, Kikonyogo, as she went to visit the neighbours.

Upon return after a short while, she found her child crying and bleeding profusely from her private parts.
The Court heard that Kikonyogo told his wife that the child had fallen on a sharp object in a basin, which pierced its private parts.

However, his wife rejected the story and took the baby for a medical examination. She found that the toddler had been defiled and alerted the neighbours.

The father was arrested and taken to Namwendwa Police post where he was charged with defilement of the first degree.

The court agreed with the Principal State Attorney, Fred Waninda, and rejected the appeal.

The attorney had said the trial court held in Jinja had properly evaluated the evidence and had come to a just conclusion considering that the offence carries a death sentence.

“After considering the submissions of both counsels in this criminal appeal, we find no merit in it and, we accordingly dismiss it,” the court ruled on Thursday. The coram was chaired by Chief Justice Benjamin Odoki.
