THE High Court has given the Government 15 days to file a defence against a suit in which a Kampala property mogul, Sudhir Ruparelia, seeks to evict the Chieftaincy of Military Intelligence (CMI) from his land.

Sudhir, through Speke Hotel Limited, sued the Attorney General, representing the State, also seeking compensation of sh25m in damages for refusing to vacate his property.

Sudhir filed the case through Nangwala, Rezida and Company Advocates on October 30 in the Land Division of the High Court.

The 6.204-acre land is situated along Kira /Yusuf Lule roads.

Sudhir contends that Speke Hotel is the registered proprietor of the property, having obtained the registration from the Ministry of Lands in October 2006, with a signed lease agreement from the Uganda Land Commission.

He says he is supposed to build a modern shopping mall and a five-star hotel, which should be completed in May 2011. He also says he agreed to pay for the relocation of CMI.

It is said the lands ministry wrote to the defence ministry, suggesting that CMI negotiates with Sudhir for appropriate and suitable relocation of the intelligence headquarters, so that development could begin.

Sudhir says in December 2006, he sought an appointment with the relevant authority to discuss the modalities, but to his great dismay, he has hitherto received no response from any of them.
