The Principal Judge Yorokamu Bamwine has recalled Kampala business woman Jackline Uwera Nsenga’s murder file.
AS a result, hearing of the case in which Uwera is accused of murdering her husband, Juvenal Nsenga Kananura has been postponed.
Both parties turned up in court but were shocked upon learning the Principal Judge upon request.
Defense lawyers Mubiru Nsubuga and Francis Niinye, state prosecutor Julius Tuhirwe and three court assessors had turned up for the hearing.
Justice Wilson Masalu Musene told court that the file was forwarded to Principal Judge Yorokamu Bamwine asked for the file after Uwera complained that the murder case was cause-listed for trial at Nakawa High Court before committal.
“We sat with Justice Elizabeth Nahamiya and decided to first track the murder case but the Principal Judge re-called the file. May be for another criminal session following some complaints,” Musene said.
Musene however, advised defense lawyers to make a follow up of the file with the Principal Judge.
Prosecution alleges that the marriage between the couple had become quite turbulent and the accused had on several occasions issued specific and general threats against her late husband. The deep-seated animosity split over to other family members including all her in-laws and Uwera rebuffed efforts by friends and relatives geared at reconciling her with the late husband but all in vein.
Prosecution further alleges that on January 10, 2013 the accused returned home at around 9:00pm, parked her vehicle Reg. N0. UAL 933M outside the main gate and pressed the bell.
In response, her late husband walked toward the gate and opened for his wife to affect entry but the accused instead accelerated her vehicle, rammed past the gate and knocked him down and dragged him for some considerable distance along the concrete pavement.
