A property developer has sued Kyadondo East MP Ibrahim Ssemujju Nganda, for allegedly defaming him by branding him a proxy for powerful politicians.
Twed Consulting Limited managing director Dr Dan Twebaze filed a civil suit on September 18 at the High Court in Kampala. It was filed through BNB Advocates.
The purportedly defamatory utterances were published this year in Ssemujju’s column in The Observer newspaper edition of Wednesday June 5-6, 2013. The online edition on newspaper’s website is dated June 4, 2013.
The contentious piece was titled ‘Ssemujju Nganda: Monitor, RP back but country remains under siege’.
Twebaze owns two prime city properties; Twed Plaza on Plot 22 Lumumba Avenue, and Twed Towers located on Plot 10, Kafu Road.
Twed Towers houses the High Court civil division, Land division, Court of Appeal and Constitutional Court.
In the contentious column, Ssemujju stated that he was told by ‘other people’ that the buildings are owned by Brig John Mugyenyi.
Twebaze asserts that Ssemujju’s utterances dented his profile in the eyes of his business associates. He states that the article scared his clients and potential clients.
“The words were calculated to mean that I do not have financial capacity to own property,” Twebaze asserts.
He adds that Ssemujju insinuated that the monies used to construct the property are ill-gotten.
Twebaze wants court to compel Observer to remove the online publication on their website, and render it unavailable.
He also wants the defendants permanently restrained from further publication of the defamatory articles.Twebaze is also demanding for costs and damages.
Court has ordered Ssemujju to respond to the allegations within 15 days. In the summons dated September 19, 2013, the civil division registar Tadeo Asiimwe has cautioned Ssemujju to heed, lest the case is determined in his absence.
The case file has been allocated to Justice Stephen Musota. However, a hearing date is yet to be fixed.
