Nansana MP Wakayima thrown out of Parliament

Judge Ogwang ruled that Wakayima Musoke was erroneously nominated by the Electoral Commission.

The High Court in Kampala has nullified the election of Democratic Party's Wakayima Musoke Nsereko as MP representing the newly-created Nansana Municipality constituency.

Judge Vincent Ogwang ruled that the name Wakayima Musoke Nsereko which he used for his nomination for the seat does not appear in the voters' register of Nansana Municipality but rather the name Musoke Hannington Nsereko which validly appears on his national identification card.

The court then declared NRM's Robert Kasule Ssebunya - who had finished second - as the area MP.

Judge Ogwang ruled that Wakayima Musoke was erroneously nominated by the Electoral Commission and does not qualify to be MP.

The judge also found the decision of the Wakiso returning officer Sarah Bukirwa to cancel results from 24 polling stations without a justifiable reason irregular and in non-compliance with the Parliamentary Elections Act.

Wakayima was ordered to pay costs of the petition to Ssebunya.

But it was a different set of emotions outside court where Wakayima's supporters couldn't hold back their tears. (Credit: Shamim Saad)


Following court's decision, Wakayima's supporters wept outside the court premises. Kampala Lord Mayor Erias Lukwago, also a supporter, said he was disappointed by the judge's ruling.

He said Ssebunya contested with five others who were also affected by the cancellation of results from 24 polling stations.

On his part, Wakayima said he was dissatisfied with the judgment and would consult his layers to appeal against the ruling.
