He said that he applied for retirement from the army in December 30, 2014 but received no formal response within the mandatory 90 days, indicating that he was nolonger needed in the army

Gen. David Sejusa, the former co-coordinator of intelligence services who is currently detained at Luzira Prisons, has petitioned the civil court, seeking for orders to stay his trial at the General Court Martial and order for his immediate release.

In the application seen by the New Vision, Sejusa wants the hearing of the six charges leveled against him by the General Court Martial (GCM)  be suspended until the final disposal of a civil suit he filed last year against the army.

Sejusa also wants court to order for his release from Luzira prisons where he is being held on remand on charges of participating in political party activities, insubordinate behavior, absence without leave and indiscipline, until disposal of the civil case.

In the affidavit he swore on 4th this month at Luzira Prisons, the army general contends that he has a pending case at the civil court in which he is seeking for declarations that he was by the conduct of UPDF discharged from the army.

He pointed out that the conduct of denying him salary and other benefits, withdrawal of his army uniforms and guns, refusal to deploy him, failure to provide him with any means of transport, meals and housing amounted to constructive dismissal from the army.

He said that he applied for retirement from the army in December 30, 2014 but received no formal response within the mandatory 90 days, indicating that he was nolonger needed in the army.

The civil case is currently at the hearing stage and it will resume in April 5, 2016.
