MP Karuhanga still pursuing petition against Odoki

Western Youth MP Gerald Karuhanga is still pursuing his petition in his quest to block the re-appointment of Justice Benjamin Odoki as Chief Justice, despite halting its proceedings in the Constitutional Court.

Western Youth MP Gerald Karuhanga is still pursuing his petition in his quest to block the re-appointment of Justice Benjamin Odoki as Chief Justice, despite halting its proceedings in the Constitutional Court.

Karuhanga, on January 9 instructed his lawyers not to proceed with the petition in the Constitutional Court after Justices Steven Kavuma and Augustine Sebutulo Nshimye refused to step down from the coram that was set up to hear his petition.

Retired Supreme Court Justice George Wilson Kanyeihamba, the lead counsel for the legislator, told the court that they had been instructed to halt the petition proceedings before a panel on which the two justices are still members, citing bias.

“After consultations, we have received instructions from our client not to proceed with the petition before the panel where their lordships, the Acting Chief Justice Steven Kavuma and Augustine Nshimye are still members,” he said.

“Our client is convinced that he would not receive justice when the two justices are still sitting on that panel.

And added: “He has instructed us to appeal to the Supreme Court against the unanimous decision of this court refusing its two members from stepping down.”

Karuhanga alleged that Odoki had written an administrative memo to Justice Kavuma instructing him to take charge of the Judiciary.

The legislator also contended that both Nshimye and Kavuma had been biased in the case of the MPs that had been expelled from the NRM party.
