Nsenga's widow bail ruling for today

Nakawa High Court is expected to deliver its judgment today in an appeal in which jailed businesswoman, Jacqueline Uwera Nsenga is seeking bail.

KAMPALA - Nakawa High Court is expected to deliver its judgment today in an appeal in which jailed businesswoman, Jacqueline Uwera Nsenga is seeking bail.

Uwera, 36, was charged with the murder of her husband, Juvenal Nsenga Kananura, which occurred at their home in Bugolobi.

Uwera last month through lawyer Nsubuga Mubiru applied to be released on bail pending hearing of the murder charge.

State prosecutor Samali Wakooli asked court presided over by Justice Wilson Masalu-Musene not to grant the suspect bail.

Wakooli told court on Tuesday that the suspect had produced two unsubstantial sureties in court. The sureties include Henry Katanga, LC1 chairman Bugolobi flats and Albert Murari, director of Kenlloyd Logistics Limited – both cousins of the accused.

She also said that prosecution was ready and committed to have trial of the murder case as early as next week.

“Court should exercise its discretion not to grant bail to the applicant and instead remand her until trial starts,” Wakooli insisted.

She however proposed that if the suspect is to be granted bail, the sureties should deposit land titles of their places of abode and their passports in court.

She also said court needs to balance constitutional right of appeal as well as need for the society to be protected from lawlessness. She added that the suspect may abscond and interfere with court proceedings.

Prosecution alleges that Uwera on January, 10, 2013 reportedly knocked her husband dead at the entrance of their home in Bugolobi, a Kampala suburb.
