THE Democratic Party (DP) officials charged with issuing a false report about the murder of Uganda Freedom Movement leader Andrew Lutakome Kayiira have asked court to dismiss the case.

DP president John Ssebaana Kizito, Kampala Central MP Erias Lukwago and Kyaddondo South MP Issa Kikungwe argued that the Government had lost interest in the case.

Through their lawyer, Nyanzi and Company Advocates, the trio threatened to drag the Government to court if the case is not withdrawn within a month.

“We have been travelling to this place for about two and half years, but we have not seen any sign of interest in this case by the Government,” Lukwago said after the Masaka Chief Magistrates Court adjourned the hearing to June 18.

“We have lots of things to do. We are wasting time coming here. The Government has failed to produce any evidence against us even though the State claims to be having a number of witnesses,” Lukwago said.

The trio is accused of uttering a false document in a rally held at the Masaka Mayor’s Garden in January 2007 over the murder of Kayira in 1987.

The court had earlier threatened to issue a warrant of arrest against Ssebaana for not turning up. But Nyanzi argued that he had represented Ssebaana, saying he was undergoing treatment.
