Colgate sues importer over trademark

THE Commercial Court has ordered the Uganda Revenue Authority (URA) to detain consignments of “Collage Herbal Toothpaste” to Kampala Stocks Supermarket until a case against it is heard.

This followed an application by Colgate- Palmolive seeking a temporary order restraining Kampala Stocks Supermarket (KSS) from collecting the goods currently under URA custody, saying the firm had infringed on the rights of its trademark.

Earlier, Colgate- Palmolive sued KSS seeking to destroy all the consignments of the toothpaste made under the Collage Herbal Toothpaste trademark, alleging that the firm had violated the trademark law by passing-off and interfering with its sole rights of the trademark.

It is also seeking an order requiring KSS to show all the documents bearing the plaintiff’s trademarks and get-up, an account of profits, damages for the infringement and costs.

Palmolive wants a permanent order stopping KSS from any further trademark infringement.
