High Court jails defiler for 11 years

A 29-YEAR-OLD man has been sentenced to 11 years in prison for defiling a five- year-old girl.

A 29-YEAR-OLD man has been sentenced to 11 years in prison for defiling a five- year-old girl.

The High Court in Mbarara, presided over by Justice Kibuuka Musoke, on Tuesday found Patrick Subi-Subi guilty of defiling his neighbour’s daughter.

Prosecution told court that on May 31, 2005, Subi-Subi called the child into his house in Kigaga village, Mbarara district, promising to give her mangoes, but he instead defiled her.

“The victim was playing with her peers in the compound and Subi-Subi called her inside the house where he defiled her. The other children heard the victim’s cries and went into the house where they found Subi-Subi raping her.”

Court heard that Subi-Subi knew that the girl’s mother had gone for a funeral and left her under the care of her older children.

Prosecution asked the judge to give the accused a maximum sentence.

However, his lawyer Peter Kabegambaire requested for a minimum sentence, saying the accused was a first-time offender and still useful to the society.

Passing his judgement, the judge said although the accused was a first-time offender and had been in prison for four years, court had not found him repentant.

He added that the accused acted in a brutal manner by defiling his neighbour’s daughter whom he should  have taken care of.
