Dr. Kiggundu Appeals Against Retrial

FORMER managing director of the defunct Greenland Bank, Dr. Sulaiman Kiggundu, has appealed against court’s order to retry him on charges of causing financial loss to the bank.

FORMER managing director of the defunct Greenland Bank, Dr. Sulaiman Kiggundu, has appealed against court’s order to retry him on charges of causing financial loss to the bank.Hilary Kiirya reports that Kigundu, through his lawyers Elias Lukwago of Lukwago & Alaka Company Advocates, said the Buganda Road Court Chief Magistrate Frank Nigel Othembi, has no power to try the case.He said Othembi is barred by Section 142 of the Magistrate’s Court Act, which states that a third magistrate does not have jurisdiction to try the case. Kiggundu said even the High Court does not have the power to confer upon court such jurisdiction.Othembi on Wednesday said the High Court had ordered a fresh trial.Ends
