UGANDA National Examinations Board (UNEB) is to appeal against a case it lost to three primary schools in western Uganda for having nullified their pupils’ results.

The High Court last week ordered the national examinations’ body to release the Primary Leaving Examinations results of 270 pupils of Kibiito and Bubwika primary schools in Kabarole district, and Makondo Primary School in Bundibugyo district.

These were part of the 1,499 candidates whose results were nullified by UNEB at the primary level, this year.
But, the national examinations body’s publicist, Eva Konde, said they are going to appeal.

“We were not contented with the judgment. We pray that this is overturned because we executed our duties with so much care and thorough cross-checks. We could not have erroneously cancelled the affected pupils’ results,” Konde explained.

“Our team of lawyers has already been directed to file an appeal,” she added.
Passing the ruling in Fort Portal last week, Justice Owiny Dollo said UNEB acted unlawfully when it nullified the results.

Dollo said the pupils were not given a chance to defend themselves and ordered UNEB to pay sh500,000 to each pupil.

Should the ruling stand, it will set a precedent of having schools go to court wherever their results are cancelled.
Results can only be nullified when candidates breach regulations, or are involved in examination irregularities, misconduct or dishonesty.
